Propertiful is a service operated by Energy Financial Services LLC ("Propertiful," "we," "us," or "our"). By accessing or using the Propertiful website, portal, or SMS services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

To access certain features of the portal, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Propertiful provides property information for informational purposes. While we strive for accuracy, we do not guarantee the completeness or accuracy of property listings, valuations, or market data. You are responsible for conducting your own due diligence before making any investment decision.
Real estate transactions conducted through Propertiful are subject to the terms of the applicable purchase contract. Earnest money deposits are governed by the terms specified in your signed contract. Propertiful acts as an intermediary and is not a party to the purchase agreement between buyer and seller.
By accessing property details through the Propertiful portal, you agree not to contact sellers directly or circumvent Propertiful in any transaction for properties discovered through our platform. Violation of this provision may result in termination of your account and legal action.
All content on the Propertiful website and portal, including text, graphics, logos, software, source code, property data, and listing compilations, is the property of Energy Financial Services LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your own personal or internal business use. You acquire no ownership of any content, data, or code made available through the Services.

To the maximum extent permitted by law, Energy Financial Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to loss of profits, data, or investment opportunities.
Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied. Propertiful does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
You agree to indemnify, defend, and hold harmless Energy Financial Services LLC and its officers, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, your violation of any law or the rights of a third party, or any transaction you enter into with another party through the platform.

Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with the arbitration taking place in or near Houston, Texas. Judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver: You and Propertiful agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
You may not assign or transfer these Terms or your rights under them without our prior written consent. Propertiful may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
